About these Terms1.1 These Terms of Service apply to services and products provided by Enhanced Endurance ABN 37 782 110 789 (we, us, our).1.2 By purchasing, accessing, or using our services or website, you agree to these Terms.1.3 If you do not agree, do not purchase, access, or use our services.1.4 We may update these Terms from time to time. The current version is always available on our website. Material changes will be notified to active athletes by email at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.2. Services2.1 We provide endurance sports coaching, education, training programming, and related services delivered online and, where agreed, in person.2.2 Service descriptions, inclusions, and delivery methods are described on our website or in writing.2.3 We may update service features, delivery methods, or inclusions for safety, quality, legal, or operational reasons.2.4 If a change materially reduces the core service you paid for, you may cancel and receive a pro-rata refund for the unused portion.3. Coaching, not medical care3.1 We provide coaching and education services only.3.2 We do not provide medical advice, diagnosis, or treatment.3.3 You remain responsible for seeking medical advice and medical care where appropriate.4. Client responsibilities4.1 You agree to:
(a) provide accurate information relevant to service delivery and training safety
(b) communicate honestly about injuries, symptoms, fatigue, readiness, and recovery
(c) follow training responsibly and within your own limits
(d) stop exercise and seek medical care when appropriate
(e) use our services and materials for your personal use only
(f) comply with applicable laws, event rules, and safety requirements
(g) provide and maintain an emergency contact name and phone number
(h) maintain current membership and personal accident insurance with the relevant national sporting body (such as AusCycling or Triathlon Australia) where relevant to your training and racing.
5. Our responsibilities5.1 We will:
(a) provide the services with due care and skill
(b) design and adjust coaching based on the information you provide and your stated goals
(c) provide support through the communication channels included in your service
(d) aim to respond within 1 to 2 business days, noting this may vary during peak periods or public holidays.
6. Fees, billing, and payment authority6.1 Prices are in AUD unless stated otherwise.6.2 Coaching fees are billed monthly in arrears at the end of each calendar month for services delivered during that month.6.3 As a condition of ongoing services, you must maintain a valid payment method on file. Invoices will be automatically charged to that payment method on the invoice date.6.4 If payment fails, you must provide an alternative valid payment method within 7 days.6.5 If payment is not received within 7 days of the invoice date, we may suspend services, including access to TrainingPeaks and other coaching platforms, until payment is received.6.6 If payment remains overdue beyond 14 days, we may terminate the coaching relationship under clause 9.6.7 You remain liable for all fees for services delivered up to the date of suspension or termination.6.8 If GST applies, it will be stated where required.7. Memberships, cancellations, and refunds7.1 Coaching is provided on a rolling monthly basis unless otherwise agreed in writing.7.2 You may cancel coaching at any time by written notice to [email protected]. The date of notice is the date the email is received by us.7.3 Verbal cancellations, chat messages, or social media messages do not constitute notice until acknowledged by us in writing.7.4 Cancellation takes effect on the date written notice is received, unless a later date is specified by you.7.5 You remain liable for all coaching fees for services delivered up to the effective cancellation date. The end-of-month invoice will include all days of coaching delivered in that month, including the date of cancellation.7.6 Cancellation does not relieve you of payment obligations for invoices already issued or for services already delivered.7.7 We do not provide refunds for change of mind, non-use, or partial use of services during a billing period.7.8 All loaned equipment, kit, and other Enhanced Endurance property must be returned within 14 days of the effective cancellation date in accordance with the Equipment Loan Schedule and Athlete Agreement.7.9 Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law.8. Consumer guarantees8.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law.8.2 If a consumer guarantee is not met, you may be entitled to remedies such as cancellation, refund, repeat performance, or compensation, depending on the circumstances.9. Suspension or termination9.1 We may suspend or terminate services if:
(a) payment remains overdue after reasonable notice in accordance with clause 6
(b) you engage in abusive, threatening, unlawful, or harassing conduct
(c) you repeatedly ignore safety instructions in a way that creates risk
(d) you knowingly provide false information that materially affects service delivery or safety
(e) you share, copy, resell, or misuse our materials in breach of these Terms.
9.2 Where practical, we will give notice and an opportunity to remedy the issue.9.3 We may suspend services immediately where there is a serious safety, conduct, or fraud concern.9.4 If we terminate for reasons other than serious misconduct, fraud, or non-payment, we will refund any prepaid unused portion.9.5 On termination for any reason, you must return all loaned equipment, kit, and other Enhanced Endurance property within 14 days. Items not returned within this period will be treated as non-returned and the replacement value will become payable in accordance with the Equipment Loan Schedule.10. Cost recovery10.1 If we are required to take steps to recover overdue payments or unreturned property, you agree to pay our reasonable recovery costs, including collection agency fees, legal costs, and bank dishonour fees.11. Intellectual property11.1 All content, tools, plans, documents, templates, graphics, branding, and materials we provide are owned by us or licensed to us.11.2 We grant you a personal, revocable, non-transferable licence to use those materials for your own training and education only.11.3 You must not copy, reproduce, distribute, publish, resell, sublicence, or share our materials without written permission.12. Community and social media conduct12.1 If you post in our community spaces, pages, or groups, you agree to be respectful and lawful.12.2 We may remove content that is abusive, defamatory, misleading, unlawful, or unsafe.12.3 We will not use your images, videos, testimonials, or identifiable media for marketing without your separate opt-in consent.13. Privacy13.1 Our Privacy Policy explains how we collect, use, store, and disclose personal information, including any health information you choose to provide.13.2 Our Privacy Policy is available on our website.14. Liability14.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot lawfully be excluded.14.2 To the extent permitted by law, we exclude liability for indirect or consequential loss, including loss of profit, revenue, opportunity, or data.14.3 Participation in training and recreational services carries inherent risk.14.4 Liability for death or personal injury arising from recreational services is addressed in the separate Athlete Agreement and risk warning.15. Dispute resolution15.1 If a dispute arises, the parties agree to first attempt to resolve the dispute by good faith discussion within 14 days of written notice of the dispute.15.2 If the dispute is not resolved, either party may refer the dispute to mediation through a mutually agreed mediator before commencing legal proceedings, except in cases of urgent injunctive relief or unpaid invoices.16. General16.1 If any part of these Terms is unenforceable, the remaining parts continue to apply.16.2 Our failure to enforce a right immediately does not waive that right.16.3 These Terms are governed by the laws of Victoria, Australia.16.4 Courts of Victoria have non-exclusive jurisdiction.17. ---Part A. Parties and purpose1.1 This Athlete Agreement is between Enhanced Endurance ABN 37 782 110 789 (we, us, our) and the athlete named below (you, your).1.2 This Agreement applies to endurance coaching, training programming, education, feedback, race review, and related services provided by us.1.3 This Agreement operates together with our current Enhanced Endurance Terms of Service published on our website at https://enhanced-endurance.com/#terms.1.4 If there is any inconsistency:
(a) this Athlete Agreement prevails for health, safety, privacy collection notice, coaching data use, coaching footage use, media consent, and equipment loan matters
(b) the Terms of Service prevail for fees, billing, cancellations, refunds, intellectual property, and website use.
1.5 We may update this Agreement from time to time. Material changes will be notified to you by email at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the updated Agreement.Part B. Coaching relationship2.1 You request and consent to receive endurance coaching and related services from us.2.2 You understand that our services are coaching and education services only.2.3 We do not provide medical advice, diagnosis, or treatment.2.4 You agree to continue to seek care from your doctor or other health professional where appropriate.2.5 This Agreement becomes binding on the earliest of:
(a) the date you sign this Agreement
(b) the date you confirm acceptance by email
(c) the date you make your first payment for services
(d) the date you connect your TrainingPeaks account to Enhanced Endurance.
Part C. Athlete responsibilities3.1 You agree to:
(a) provide accurate information relevant to training safety, exercise tolerance, and program design
(b) update us if your health, injury status, symptoms, medication use, or training availability changes
(c) communicate honestly about fatigue, pain, illness, readiness, and recovery
(d) complete training within your own limits and in a safe environment
(e) follow reasonable safety instructions we provide
(f) use our services and materials for your own personal use only
(g) comply with event rules, road rules, venue rules, and equipment instructions
(h) provide and keep current an emergency contact name and phone number
(i) certify that you are physically fit to undertake endurance training at the prescribed intensity, and notify us immediately if this changes
(j) maintain current membership and personal accident insurance with the relevant national sporting body (such as AusCycling or Triathlon Australia) where relevant to your training and racing
(k) return all loaned equipment, kit, and other Enhanced Endurance property in accordance with Part K and any applicable Equipment Loan Schedule.
Part D. Health disclosure and stopping rules4.1 You confirm that you have disclosed, to the best of your knowledge, any injury, illness, symptoms, diagnosis, medication, or limitation that may reasonably affect training safety, exercise tolerance, or program design.4.2 You agree to update us promptly if any relevant health matter changes during the coaching relationship.4.3 You agree to stop exercise and seek medical care promptly if you experience concerning symptoms, including chest pain, fainting, new neurological symptoms, severe shortness of breath, or signs of heat illness.4.4 If you choose not to provide information reasonably requested for coaching delivery or safety, we may be unable to provide services, tailor your training appropriately, or continue the coaching relationship safely.4.5 You acknowledge that our coaching advice, training adjustments, and safety decisions rely on the accuracy and completeness of the information you provide.Part E. Emergency response consent5.1 You authorise us to arrange first aid and/or emergency medical assistance if we reasonably believe it is necessary.5.2 You understand that any costs charged by medical providers or emergency services are your responsibility.5.3 You acknowledge that emergency responders and medical providers make their own decisions once involved.5.4 You agree to provide and keep current an emergency contact name and phone number. This person must not be a current Enhanced Endurance athlete.Part F. Risk warning and liability notice6.1 You understand that endurance training, racing, and related recreational services involve inherent risk.6.2 Risks may include, without limitation:
(a) falls, collisions, traffic incidents, and equipment failure
(b) heat illness, dehydration, and hyponatraemia
(c) asthma events, cardiac events, and other acute medical events
(d) muscle, tendon, ligament, bone, and joint injuries
(e) aggravation of a pre-existing condition
(f) psychological stress, fatigue, or reduced concentration
(g) serious injury, illness, or death.
6.3 You voluntarily accept these risks and choose to participate.6.4 You acknowledge that our services may include directing you to attend third-party venues, testing facilities, velodromes, and events. We are not responsible for the safety, conduct, or condition of third-party venues, events, equipment, or personnel. You participate in these activities at your own risk and subject to the terms of the relevant third-party operator.6.5 WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not in accordance with the statutory guarantees outlined below.Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you:
- are rendered with due care and skill; and
- are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
- might reasonably be expected to achieve any result you have made known to the supplier.
Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.6.6 To the extent permitted by law, and except where liability cannot lawfully be excluded or limited, you acknowledge and agree that participation in recreational services is at your own risk.Part G. Privacy collection notice7.1 We collect personal information that is reasonably necessary to deliver coaching services, manage safety, administer our business, and communicate with you.7.2 This may include:
(a) identity and contact details
(b) emergency contact details
(c) billing and transaction records
(d) training history, goals, performance data, and platform data
(e) health information you choose to provide that is relevant to training safety or exercise tolerance
(f) communications, notes, screenshots, files, and submitted media used for coaching.
7.3 We collect this information directly from you and, where you authorise or connect them, from training platforms, wearable services, and related third-party services.7.4 We use this information to:
(a) design and adjust your training
(b) provide coaching feedback and athlete support
(c) manage safety and make appropriate coaching decisions
(d) administer invoicing, record keeping, and service delivery
(e) improve our systems and operations.
7.5 We do not sell your personal information.7.6 We may disclose your information to service providers reasonably required to run the business, such as coaching platforms, cloud storage providers, invoicing systems, and professional advisers, and where required by law or to lessen a serious threat to health or safety.7.7 Some providers we use may store or process data outside Australia.7.8 If you do not provide information reasonably necessary for coaching delivery or safety, we may be unable to provide or continue services.7.9 You may request access to, or correction of, your personal information by contacting us.7.10 Our full Privacy Policy is available at: https://enhanced-endurance.com/#termsPart H. Coaching footage and performance data use8.1 As part of coaching services, we may collect, receive, store, review, and use footage, images, audio, and related performance data that you submit, or that is captured using issued equipment, for coaching delivery.8.2 This may include race footage, training footage, screenshots, ride files, GPS data, pace, power, heart rate, lap data, notes, and related performance material.8.3 We may use this material internally for coaching purposes, including race review, technical feedback, tactical analysis, progress review, communication with the athlete, and athlete development.8.4 This clause does not allow us to use your footage or media for public, promotional, advertising, testimonial, or marketing purposes. Any such use requires your separate optional media consent.Part I. Fees, billing, and cancellation9.1 Coaching fees are billed monthly in arrears at the end of each calendar month for services delivered during that month.9.2 As a condition of ongoing services, you must maintain a valid payment method on file. (c) cease use of all Enhanced Endurance materials, tools, and intellectual property except as expressly permitted.
Part K. Loaned equipment and kit11.1 From time to time we may issue loaned equipment (such as cameras, mounts, sensors) or branded kit (such as jerseys, apparel) to you for coaching or representation purposes.11.2 All loaned equipment remains the property of Enhanced Endurance at all times.11.3 The detailed terms for any loaned equipment are set out in the Equipment Loan Schedule, which must be signed before equipment is issued.11.4 Branded kit issued to you is provided on a loan basis unless we confirm in writing that it has been gifted or transferred to you. You must return all loaned kit within 14 days of the effective date of cancellation or termination, in clean and reasonable condition. Items not returned within this period will be treated as non-returned and the replacement value will become payable.11.5 The replacement value for branded kit is the current retail cost of the item plus any custom production or shipping costs reasonably incurred by us to issue or replace the item.Part L. Purpose1.1 The equipment is loaned to the athlete for coaching-related use, including training and race footage capture where applicable.1.2 The equipment remains the property of Enhanced Endurance at all times.2. Athlete responsibilities2.1 The athlete agrees to take reasonable care of the equipment.2.2 The athlete agrees to use the equipment only for its intended purpose.2.3 The athlete agrees not to lend, transfer, or permit another person to use the equipment without written permission from Enhanced Endurance.2.4 The athlete agrees to follow any basic charging, storage, mounting, handling, and return instructions provided.3. Loss, theft, damage, and non-return3.1 The athlete is responsible for the equipment while it is in their possession.3.2 If the equipment is lost, stolen, damaged beyond fair wear and tear, or not returned, the athlete agrees to pay the reasonable repair or replacement cost.3.3 Enhanced Endurance may provide written notice of the repair or replacement amount before payment is required.4. Fair wear and tear4.1 The athlete is not responsible for fair and reasonable wear and tear arising from ordinary intended use.5. Reporting issues5.1 The athlete agrees to notify Enhanced Endurance as soon as practicable if the equipment is lost, stolen, damaged, or not functioning properly.6. Return of equipment6.1 The athlete agrees to return the equipment by the agreed return date, or earlier if requested by Enhanced Endurance on reasonable notice.6.2 Equipment must be returned with all supplied accessories.7. No guarantee of footage or performance7.1 Enhanced Endurance does not guarantee that the equipment will capture usable footage in every setting or event.7.2 The athlete accepts that camera angle, mounting position, battery life, weather, event conditions, crashes, or technical failure may affect footage quality.8. Safe use8.1 The athlete is responsible for ensuring the equipment is mounted and used in a safe manner.8.2 The athlete remains responsible for complying with event rules, venue rules, and organiser requirements regarding camera use.Athlete signature: ______________________
